The latest twists and turns in an antitrust lawsuit against NASCAR now include Michael Jordan accusing NASCAR of victim-blaming. Jordan, as the co-owner of 23XI Racing, is once again seeking a temporary injunction against NASCAR to let them proceed in the 2025 season as chartered teams despite not signing a charter.

Michael Jordan-owned 23XI Racing and Front Row Motorsports insist in a new court filing Thursday that NASCAR is “blaming victims for asserting their antitrust rights” and that the two teams should be awarded an injunction against NASCAR.

23XI and Front Row filed an antitrust lawsuit in federal court on Oct. 2 in Charlotte, against NASCAR and chairman Jim France. They were the only two teams that refused to sign the final offer of the new charter agreement, and they’re hoping to increase the revenue and influence of the sport’s teams with this lawsuit.
